ASB Apple Pay Terms

These ASB Apple Pay terms, together with other terms and conditions that apply to ASB products and services, including the ASB Mobile Banking Terms and Conditions, ASB's Credit Card Conditions of Use (if you use your ASB Visa credit card with Apple Pay) and ASB Visa Debit Card Conditions of Use (if you use your ASB Visa debit card with Apple Pay) govern the use of your ASB Card with Apple Pay. If there is any inconsistency between these ASB Apple Pay terms, and any other applicable terms and conditions that apply to ASB products and services, then these ASB Apple Pay terms will apply but only with respect to your use of Apple Pay.

Transactions made using Apple Pay are treated as "Contactless Transactions" under the ASB Credit Card Conditions of Use and the ASB Visa Debit Card Conditions of Use

You must agree to, and comply with, these ASB Apple Pay terms in order to use your ASB Card with Apple Pay. 

1. Using and managing Apple Pay

(a) You can add an ASB Card to Apple Pay on Apple devices.

(b) You will be verified when adding an ASB Card to Apple Pay. As part of the verification process we may send you a text message to your Netcode registered mobile number with a verification code.  If you are not Netcode registered, you will be required to verify your identity by calling the ASB contact centre.

(c) In some instances, when using a credit card some merchants may charge you a fee.

(d) Once you have added your ASB Card to Apple Pay and been verified, you may make Contactless Transactions using Apple Pay.  You may be required to enter your ASB Card PIN into the merchant's terminal or enter your mobile phone security credentials (e.g., PIN, passcode or biometric identifier) on your Apple device to complete a transaction.

(e) Instructions on how to add, or unlink an ASB Card from Apple Pay are available on our website: asb.co.nz/apple-pay or through the New Zealand Apple Pay website. Alternatively, you can also ask us to unlink your ASB Card by calling the ASB contact centre.

(f) Apple Pay is a payment platform made available by Apple through the Apple Wallet app, and not by us. You must agree to Apple’s Apple Pay terms and conditions in order to register your ASB Card and use it with Apple Pay.  We are not responsible for any loss you suffer in relation to:

(i)  any error, defect or unavailability of Apple Pay; or
(ii) any failure or refusal of merchants to process transactions using Apple Pay.

2. Sharing and using information

We may exchange information (including information about you and your Apple device) with Apple and our third party service providers in relation to your set up and use of Apple Pay.  By using Apple Pay you agree that:

(a) Apple may provide us with information about you, such as your Apple device details, telephone number and other information to help us identify fraud, and for security purposes.  We may use the information that Apple provides us about you to:

(i)   enable your ASB Card to be used with Apple Pay;
(ii)  provide you customer support and assist you;
(iii) detect and manage fraud; and/or
(iv) comply with applicable laws and regulations.

We may provide information about you to Apple and our third party service providers that we use to enable your use of Apple Pay.  Apple and these third party service providers may use information we provide them to enable your use of the ASB Card with Apple Pay, to  help prevent and detect security breaches and fraud, and to operate and generally improve Apple Pay and other Apple products.   Apple may collect and use your information in accordance with its own information collection and handling practices.  Please refer to Apple’s privacy policy (available at https://www.apple.com/nz/legal/privacy/en-ww/).

(b) We may contact you to provide you information about Apple Pay, your use of Apple Pay and to share information about Apple Pay’s features and promotions relating to ASB and Apple Pay.  We may contact you by:

(i)   sending an email to the email address that you
(ii)  sending a text message to your Apple device;
(iii)  writing to you at the address you have provided to us; and/or
(iv)  sending a push notification to your Apple device.

(c) If you do not want us to collect, hold, disclose or use information as set out in this section, you should not register an ASB Card for use with Apple Pay.  If you do not want us to contact you about Apple Pay’s features and promotions, please unsubscribe by:

(i)   replying STOP – if received via Text;
(ii)  selecting unsubscribe at the bottom of the message – if received via email or notification;
(iii) letting our staff member know that you no longer want to be contacted via phone – if called;
(iv) calling the ASB contact centre and letting us know that you no longer want to be contacted via post – if received via post; or
(v) logging into FastNet Classic internet banking at any time and select Communications from the drop down menu in the top right of the screen. Here you can select how you would like to hear from us and what information you are interested in.

(d) We may also collect, hold, use, disclose and manage your information in accordance with other ASB terms and conditions that apply to your use of ASB products and services (for example, in relation to your ASB Visa credit card, please refer to ASB’s Credit Card Conditions of Use). 

(e) You have rights of access to, and correction of, personal information (as defined by the Privacy Act 1993) held by us.  Our address is ASB Bank Limited, ASB North Wharf, 12 Jellicoe Street, Auckland 1010.

3. Security Requirements for Apple Pay

You must take reasonable steps to secure your Apple device on which your ASB Card has been registered with Apple Pay.  When you use your ASB Card with Apple Pay you are also responsible for ensuring that:

(a) any password of your Apple device is kept secret and secure, not easily guessed or deciphered (e.g. your date of birth), and not shared with another person.

(b) no one else’s biometric identifier (e.g. fingerprint, facial recognition, etc.) is registered on your Apple device.

(c) your Apple device is not left unattended, is locked when not in use, and up-to-date software is installed on it.

(d) you only use Apple Pay on your Apple device or an Apple device that you are authorised to use and not on a shared device.

(e) any ASB Cards are unlinked/removed from your Apple device before disposing of it.

(f) you follow the requirements in the ASB Credit Card Conditions of Use and/or ASB Visa Debit Card Conditions of Use in relation to the ‘your card and pin’ sections.

If you do not comply with the requirements in this section you will be treated as having caused or contributed to loss arising from the unauthorised use of your ASB Card.  The amount of potential liability you have is defined in the ASB Credit Card Conditions of Use (if you are using Apple Pay with your ASB Visa credit card) and/or the ASB Visa Debit Card Conditions of Use (if you are using Apple Pay with your ASB Visa debit card). 

4. What to do if there is a Problem

You should check your transaction history regularly to make sure there are no errors or unauthorised transactions.   You must notify us immediately by phoning 0800 803 804 (if in New Zealand) or +64 9 306 3000 (if overseas) if:

(a) your ASB Card or Apple device has been lost or stolen.

(b) you suspect someone else has used your account without your permission or may have access to your Apple device or know your security credentials or ASB Card PIN.

(c) you know or suspect that another person may be able to unlock your Apple device and/or store their biometric identifiers on your Apple device.

You should immediately unlink your ASB Card from Apple Pay if your Apple device is stolen or lost. Instructions on how to unlink your ASB Card are available on the Apple Pay website and the Apple Wallet app.

5. Fees and Charges

We do not impose any additional fees and charges for registering and using your ASB Card with Apple Pay. However, you may need to pay any third party fees and charges associated with downloading, registering and using Apple Pay on an Apple device.

6. Rights we have

In addition to our rights of suspension and/or termination in the ASB Credit Card Conditions of Use and ASB Visa Debit Card Conditions of Use, we may suspend or terminate use of your ASB Card with Apple Pay without prior notice at any time, including if:

(a) you ask us to suspend or close the account that the ASB Card is linked to.

(b) you breach these ASB Apple Pay terms.

(c) we suspect unauthorised transactions have occurred.

(d) we are required to by a regulatory or government body.
 

7. Change to terms

We may make changes to these ASB Apple Pay terms at any time.  We will give you notice and communicate these changes before the change takes effect, either by direct communication, by notice in the media (including public notices), by notice on ASB’s website or by any other method of electronic communication used by you.  If you do not agree to any changes to these ASB Apple Pay terms, then you must stop using your ASB Card with Apple Pay before that change comes into effect.

8. Governing law

These ASB Apple Pay terms are governed by New Zealand law.

9. Meaning of words

"Apple"

means Apple, Inc. and/or its subsidiaries, affiliates and related entities.

"Apple device"
is any Apple equipment or Apple device that supports Apple Pay and is used to access your account, including an iPhone mobile phone, Apple Watch, iPad tablet or Macbook.
"Apple Wallet app"
means app made available by Apple to facilitate Apple Pay payments.
"ASB Card"
means any ASB Visa credit card, ASB Visa debit card or any other device or instrument we allow you to use to make Contactless Transactions that has been issued by ASB to you and is eligible to be used for Apple Pay.  It includes renewal, replacement and additional cards, Business credit cards, and Visa Business Rewards credit cards.   You will be notified if your ASB card is eligible when you attempt to register it with Apple Pay.
"Contactless Transaction"
has the meaning given in:
(a) ASB's Credit Card Conditions of Use (if you are using an ASB Visa credit card with Apple Pay); or
(b) ASB Visa Debit Card Conditions of Use (if you are using an ASB Visa debit card with Apple Pay).). 
"password"
means any password or code either we or a third-party gives you, or that you create, that must be used before we, or a third-party, process a transaction. This includes PINs, internet, phone or mobile banking passwords, and codes generated by security token.
"transaction"

has the meaning given in:
(a) ASB's Credit Card Conditions of Use (if you are using an ASB Visa credit card with Apple Pay); or

(b) ASB Visa Debit Card Conditions of Use (if you are using an ASB Visa debit card with Apple Pay). ). 

"we", "us", "our", or "ASB"
means ASB Bank Limited.
"you" or "your"
means the person(s) or business organisation that holds the ASB Card that is used for Apple Pay.

Apple, Apple Pay and Touch ID are trademarks of Apple Inc. iPhone, iPad, iTunes and Apple Watch are trademarks of Apple Inc., registered in the U.S. and other countries. App Store is a service mark of Apple Inc.
