Google Pay with ASB Terms and Conditions

These ASB Google Pay Terms and Conditions, the ASB Mobile Banking Terms and Conditions, together with the other applicable Terms and Conditions for your ASB products and services, including ASB’s Credit Card Conditions of Use and/or ASB Visa Debit Card Conditions of Use  govern the use of your eligible ASB Card with Google Pay.

In addition to these terms and conditions you must also agree to, and comply with Google's Google Pay Terms of Service in order to use Google Pay with ASB Cards.

You must agree to and comply with these Google Pay terms and conditions in order to use Google Pay.

1. Using and managing Google Pay

a) You can add an eligible ASB Card to Google Pay on eligible Android Devices.  Google, in its sole discretion, determines which devices are eligible for the registration of ASB Cards in Google Pay.

b) You will be verified when adding an ASB Card to Google Pay. As part of the process we may send you a text message to your Netcode registered mobile with a verification code. If you are not Netcode registered, you will be required to verify your identity by calling the ASB contact centre.

c) Once you have added your ASB Card to Google Pay and been verified, you may make transactions using Google Pay. You may be required to enter your ASB Card PIN into the merchant's terminal or enter your mobile phone security credentials (e.g., PIN, passcode or biometric identifier) on your Android Device to complete a transaction. d) Instructions on how to add, or remove an ASB Card from Google Pay are available on our ASB Google Pay web page.  Alternatively, you can add or remove your ASB Card from Google Pay from the Card Control screen (accessed from Cards & Devices) found within the ASB Mobile App.

e) You must nominate a card in Google Pay to make transactions. The nominated card will be your default card in Google Pay. Transactions will be debited from the card account for your default card in Google Pay unless you select a different card for the transaction. You must have selected Google Pay as the default mobile wallet application on your Android Device’s settings to make transactions with Google Pay.

2.Google Pay Service

a) Google Pay is a service provided by Google, not by us. We provide your information to Google to allow the use of an ASB Card through Google Pay. We are not responsible or liable for any loss you suffer in relation to:

i) any error, defect or unavailability of Google Pay or any Android Device; or
ii) any failure or refusal of merchants to process transactions using Google Pay.

3. Sharing and using information

a) We may collect and exchange information with Google and other third party service providers, including Visa Worldwide Pte Limited, when you set up and use Google Pay. By using Google Pay you agree:

i) Google may provide us with information, such as your Android Device details (e.g. phone number, device type) and information about your location (if you have location services enabled). 

ii) We may use the information about you that Google provides us:
(1) to enable your ASB Card to be used with Google Pay;
(2) to provide you customer support;
(3) to resolve any disputes;
(4) to facilitate accounting, auditing, billing, reconciliation and collection activities
(5) to improve and promote Google Pay and the user experience with Google Pay;
(6) for security purposes, including to detect and manage fraud, and
(7) to comply with applicable law and regulations and to respond to regulatory requests.

iii) We may provide Google and its service providers with information about you and your use of Google Pay. This includes providing Google with:
(1) transactional  data from your use of Google Pay; and
(2) information used to identify you and arrange for your ASB Card to be set up with Google Pay (such as your name, address and phone number).

iv) The information that we provide to Google about you may be used by Google for the purposes of:
(1) enabling you to set up and use Google Pay;
(2) providing you with visibility and information about your transactions;
(3) security , including detecting and addressing fraud;
(4) complying with applicable laws and regulations;
(5) responding to regulatory and government inquiries, and complying with applicable law;
(6) operating, managing and generally improving the Google Pay service;
(7) creating business performance reporting and analytics;
(8) promotion of the Google Pay service;
(9) performing ad attribution analysis at an aggregate level;
(10) mapping where you have used the Google Pay service, and using this data to improve the Google Pay service; 
(11) deriving information for the purposes of reporting on the acquisition of users to the Google Pay service (including reporting to third parties);
(12) using your information in connection with your Google account as permitted by Google’s policies and agreements that Google has with you.

b) Google may also use your information in accordance with Google’s privacy policy.

c) If you don’t want us to collect or disclose this information, you should not register an ASB Card for use in Google Pay.

d) We may also collect, hold, use, disclose and manage your information in accordance with other ASB terms and conditions that apply to your use of ASB products and services (for example, in relation to your ASB credit card, please refer to ASB’s Credit Card Conditions of Use).

e) Your information that we collect will be held by ASB Bank Limited, (ASB North Wharf, 12 Jellicoe Street, Auckland 1010), or our third party service providers.  You have rights of access to, and correction of, personal information (as defined by the Privacy Act 1993) held by us or our third party service providers.

4. Security Requirements for Google Pay

a) Any person who has access to your Android Device may be able to make transactions using Google Pay. You must take reasonable steps to ensure sure that no one else knows how to unlock or access your Android Device by keeping your Android Device pattern, passcode or biometric identification details secure and confidential.

b) You are responsible for ensuring that:
i) any password of your supported device is kept secret and secure, not easily guessed or deciphered (e.g. your date of birth), and not shared with another person;
ii) no one else’s biometric identifier (e.g. fingerprint, facial recognition, etc.) is registered on your device;
iii) your Android Device is not left unattended, is locked when not in use, and up-to-date antivirus software is installed on it;
iv) you only use Google Pay on your device or a device you are authorised to use and not on a shared device;
v) any ASB Cards are unlinked/removed from your Android Device before disposing of it; and
vi) you follow the requirements in the Credit Card Conditions of Use and/or Debit Card Conditions of Use in relation to the “Your Card and PIN” section for credit cards and “Keep your card safe” section for Debit cards.

c) If you fail to comply with the requirements in this clause 4 or the requirements in the Credit Card Conditions of Use or Debit Card Conditions of Use when using Google Pay, you will be treated as having caused or contributed to loss arising from the unauthorised use of your ASB Card.  The amount of potential liability you have is defined in the ASB Credit Card Conditions of Use (if you are using Google Pay with your ASB credit card) and/or the ASB Visa Debit Card Conditions of Use (if you are using Google Pay with your ASB Visa debit card). 

5. What to do if there is a Problem

a) You should check your transaction history regularly to make sure there are no errors or unauthorised transactions.

b) You  must notify us immediately by phoning 0800 803 804 (if in New Zealand) or +64 9 306 3000 (if overseas) if:
i) an eligible ASB Card or your Android Device has been lost or stolen; or 
ii) you suspect someone else has used your account on Google Pay without your permission or may have access to your supported Android Device or know your security credentials or eligible ASB Card PIN; and/or
iii) you know or suspect that another person may be able to unlock your Android Device and/or store their biometric identifiers on your Android Device.
iv) the mobile service on your Android Device is suddenly disconnected without your permission — this may indicate you have been subject to mobile phone porting or fraud, or
v) you suspect a security breach has occurred in relation to your Android Device or Google Pay.

c) You should immediately unlink your eligible ASB Card from Google Pay if your Android Device is stolen or lost. 

d) Based on your report to us we may suspend all use of your ASB Card in Google Pay and we may also suspend use of your physical ASB Card. This helps protect you as much as possible from additional loss or liability.

6. Rights we have

a) In addition to our rights of suspension and/or termination in the Credit Card Conditions of Use and Debit Card Conditions of Use, we may suspend or terminate use of your eligible ASB Card with Google Pay with or without notice at any time, including if:
i) you ask us to suspend or close the ASB card account that your eligible ASB Card is linked to;
ii) you breach these terms and conditions;
iii) we suspect unauthorised transactions have occurred; or
iv) we are required by a regulatory or government body.

7. Change to terms

We can make changes to these terms and conditions at any time. If so, we will give you notice and communicate these changes, either by direct communication, by notice in the media (including public notices), by notice on ASB’s website or by any other method of electronic communication used by you. We may require you to confirm your acceptance of changes to continue using your eligible ASB Card in Google Pay.

8. Trademarks

Android, Google Play and Google Pay are trademarks of Google LLC.

9. Meaning of words

“Android Device” refers to devices such as a smartphone, tablet or smartwatch using an Android operating system, which is eligible for use with Google Pay.

 "ASB Card" means a compatible ASB Visa debit or credit card that has been issued by ASB to you that can be used for Google Pay on an eligible Android Device. You will be notified if your card is eligible when you attempt to register it with Google Pay. 

“Conditions of Use” means the ASB Credit Card Conditions of Use for each ASB credit card, and the ASB Visa Debit Card Conditions of Use for each ASB Visa debit card added onto Google Pay.

"Google" means Google Asia Pacific Pte Ltd and/or its related bodies corporate and affiliates.

“Google Pay” means the mobile payment and digital wallet service created by Google that allows users to make payment transactions using eligible Android Devices which are registered to eligible credit cards or debit cards.

"password" means any password or code either we or a third-party gives you, or that you create, that must be used before we, or a third-party, process a transaction. This includes PINs, internet, phone or mobile banking passwords, and codes generated by security token.

"we", "us", "our", or "ASB" means ASB Bank Limited.

"you" or "your" means the person who holds the ASB Card that is used for Google Pay.
